Pittsburgh would pay a West End woman $52,500 to settle a lawsuit she filed in 2014 contending an EMS official struck her with a city vehicle as she was crossing a street in Brighton Heights.
Jennifer Batten, 36, of Crafton Heights said in a complaint that she was in a crosswalk on Sept. 11, 2013, on Brighton Heights Boulevard when District Chief Richard Linn Jr. failed to yield and struck her with an EMS vehicle as he was speeding through the intersection.
Batten suffered severe injuries, including broken bones, a concussion and muscle damages, when she was thrown to the ground and rolled along the street, according to the complaint.
Public safety spokeswoman Cara Cruz declined comment as did Patrick W. Murray, one of Batten’s attorneys.
Batten alleges that Linn was reckless and negligent. She was seeking damages in excess of $35,000.
Pittsburgh City Council introduced a resolution on Tuesday that would authorize payment of $52,500. Council is scheduled to vote on the settlement in coming weeks.
