Plum officials want to remind restaurants offering outdoor dining to be in compliance with state regulations and zoning requirements.
Letters are expected to be sent out later this month to at least five establishments that might not have proper permitting for the increased occupancy now that covid restrictions are lifting.
Restaurants were forced to rely on takeout and outdoor dining at different times during the pandemic as part of the ever-changing regulations.
“The borough, like many communities, looked the other way,” borough Manager Michael Thomas said at Monday night’s council workshop meeting. “We didn’t want to prevent people from being able to make money. However, as we are back to 100% seating capacity in restaurants now, some of these establishments still have these outdoor seating areas set up. They are not permitted. There are a few that have had outdoor dining and they did it properly.”
Officials said there are concerns about Americans with Disabilities Act accessibility and possible parking issues as a result of the improper outdoor dining changes.
“Some have had outdoor seating before, but then they’ve even added more during covid,” council vice president Dave Vento said. “That’s the areas that are a real problem (and) I think want to be brought up to some sort of compliance.”
Thomas said Plum supports local businesses, and the letters are intended to be helpful.
“All we’re saying is, if people want to use that space, they need to do it according to state regulations,” he said.
Borough officials declined to say what businesses would be receiving the letters.
